Prospekt shopping mall announces the prize-winning event for buyers

Buy the products in Prospekt shopping mall from November 05 to November 19, 2016 and take part in the drawing of the super-prize - certificates from the mall stores for the total amount of UAH 50000.

Event terms:

1. Buy the products spending more than UAH 1000 in one receipt.

2. Register your details (full name and telephone number).

3. Come to the drawing of the super-prize on November 19 at 18:30 (main stage of Prospekt shopping mall, 2^nd floor, food-court).

The winner will be determined by way of random drawing of an envelope with participant’s name.

Official rules of the Event: “Birthday of Prospekt shopping mall and VIVA! magazine”

1. Event customer.

o “Comfort Market Lux” LLC is the Event customer (hereinafter referred to as “the Customer”).

Customer’s location and mailing address: 01032, Kyiv, 33 Tarasa Shevchenka Ave., 13^th floor.

o “Infocon” Agency” PJSC is the Event Contractor. Contractor’s location: 01001, Kyiv, 46 Khreshchatyk St.

2. Event objectives.

o The Event’s objective is to draw consumer’s attention to the Birthday of Prospekt shopping mall.

3. Duration and territory (place) of Event.

o Event will last from November 05 to November 19, 2016 (hereinafter called “the Event Period”) and consists of the following stages:

♣ Stage 1 - participant’s registration upon the presence of the receipt totaling UAH 1000 will be carried out in the information desk area in Prospekt shopping mall on the 1^st floor on the following days and hours:

November 13 - from 11:00 to 20:00

November 19 - from 11:00 to 18:00

4. Event participants.

o All Ukrainian citizens having full 18 years at the moment of Event beginning and underage persons with the participation of their parents or legal guardians/custodians may take part in the Event. In addition, all incapable or partially incapable participants shall inform their parents or legal guardians/custodians about the participation in the Event.

o The following persons shall not be considered as the Event Participants and shall not have the right to take part in the Event:

• Event Customer’s employees and members of their families (husband/wife, children, brothers/sisters, parents);

• owners and employees of the advertising agencies and partners involved in the organization and holding of the Event, and members of their families (husband/wife, children, brothers/sisters, parents);

• participation in the Event of the incapable persons shall be carried out pursuant to the applicable laws of Ukraine.

o The Event Participants shall during the participation in the Event:

comply with the requirements of this Rules and of the provisions of the applicable laws of Ukraine;

• not create nuisances and not prevent intentionally the participation of the other Participants;

• not make actions discrediting the eligibility of participation of such Participant in the Event.

5. Terms of participation in the Event.

o In order to take part in the Event, the person meeting the requirements of the section 4 hereof shall:

♣ Purchase the product in any store of the Prospekt shopping mall except from the AUCHAN hypermarket totaling over UAH 1000 in one receipt.

♣ Any number of receipts can be used for participation in the Event.

♣ Register the details (name and telephone number).

♣ Receive the event seal on the receipt.

♣ Be present at the super-prize drawing that will be held on November 19 at 18:30.

o The Organizer and Customer of Event shall not bear responsibility for the fact that not anyone willing can take part in the Event.

6. Determination of the winner and procedure of receipt of the super-prize.

o The prizewinner shall be determined by way of random drawing of an envelope with participant’s name.

8. Personal details

o The Event Participant shall act personally, on his behalf, voluntarily and independently. The Event Participant shall bear all risks of responsibility and effects resulting from the possibility to take part in the Event and receipt of the prize.

o The information provided to the Event Participants shall be considered as the personal details and shall be protected pursuant to the applicable laws of Ukraine.

o By taking part in the Event each Participant declares and confirms that he is read and understood this Rules and shall comply with them, that he is familiarized with the rights concerning his personal details*, and agrees that his personal details provided willfully could be processed by the Event Contractor at his discretion in any ways for marketing and/or any other purpose not contradicting to the Ukrainian laws, in particular, for the advertising campaigns according to the official rules (determination of prizewinner, preparation of static information etc.).

* Rights of the Participant as the subject of personal details. The Participant may:

- receive the information about the location of the Contractor as the owner/administrator of his personal details;

- demand from the Contractor as the owner/administrator of his personal details their specification;

- use the means of legal defense as provided for in the applicable laws in case of violation of the laws on personal data protection.

• Event Participant shall grant to the Contractor the right to perform automatic processing and inclusion of personal details to the database of personal details and to the other databases that will be created by the Contractor for administrative and other purpose, to ensure the realization of the relations demanding the personal details processing. In addition the Participant confirms that the Contractor is not obliged to notify him about the inclusion of his personal details to the database of personal details.

• The Participant shall grant to the Contractor the right to transfer his personal details to the extent reasonable for the set objective to the third persons if such transfer is related to the fulfillment by the Contractor of his obligations (including, but not limited to, submitting the information to the public authorities, bank institutions etc.). In addition the Participants agree that the Contractor shall not notify them in written and verbal form about each event of such transfer of their personal details to the third persons.

• By taking part in the Event each Participant confirms that he is familiarized with the rules concerning the collection, processing, use, storage and distribution of his personal details, and also confirms hereby that the Contractor and the other third persons shall be exempted from the obligation to notify the Participant in written about the rights, purpose of details collection, and the persons whom the Participant’s personal details will be transferred to.

• The processing of the personal details may be performed by the Contractor independently or may be assigned to the other operators based on the contract provided the confidentiality will be preserved. The personal details of the Event Participant shall be stored in the base until their revocation by the written request of the Event Participant. In case of revocation of the consent for personal details processing the Participant shall not be allowed to the further participation in the Event.

• The Contractor/Customer shall not bear any responsibility for the protection of personal details submitted by the Participants in the questionnaire from the illegal or accidental access, elimination, misquoting, blocking, copying, distribution, and other illegal actions. The Contractor also shall not bear responsibility for the violation of the third persons as the result of Participant’s submitting of such personal details.

9. General terms of the Event.

o All Event Prizes may be received by the Event Participants only on the terms provided for herein.

o The Event Prizes shall not be replaced or returned. The Customer and the Contractor shall not bear responsibility for the use of the Prizes after their receipt by the Participant.

o Pursuant to the requirements of the article 634 of the Civil Code of Ukraine as for adhesion contracts, namely about the possibility to enter into such agreement only by way of accession by either party to the proposed contract, by their participation in the Event all Event Participants agree with the requirements of this Rules and undertake to fulfill them.

o All results of the Event are final and are not subject to any appeal.

o The procedure of determination of prizewinners is not a lottery or any other game based on risk and has not the purpose of profit-making.

o For the purpose of organization and holding of the Event, and for the purpose of control over the Event course the Organizer/Contractor shall have the right to involve any other persons. The Organizer/Contractor shall not bear the responsibility for the quality of services provided by the operators of postal, delivery and telephone services.

o This Rules, as well as any other amendments to them shall come into force at the moment of their publishing by the Organizer on the web-site prospekt.com.ua.

o The Event Customer/Contractor shall reserve the right to change the prize pool of the Event and/or the individual types of Event prizes, and to include the other prizes not provided for herein to the Event. 

10. Other provisions:

o In case of any disputes concerning the interpretation of the Event terms the Organizer’s interpretation shall be considered the final and binding for all Event Participants and shall not be subject to any appeal. The Customer/Contractor’s decisions for all matters related to the holding of the Event, shall be final and shall not be subject to any appeal, and refer to all Event Participants.

o The Event Participant by his participation in this Even agrees with the Event Terms and shall fulfill them.

o The Customer and the Contractor shall reserve the right to verify the documents evidencing the age and identity of the Participant.

o The Customer and the Contractor shall not bear responsibility for the work and any failures of the postal and delivery service operators resulting in non-arrival, late arrival, loss, or damage of mail; for the force-majeure circumstances.

o The Event Participants agree to observe the condition that they can provide the mass media with the information about the participation in the Event and about the receipt of the prize only upon the separate for each case written consent of the Organizer.

o By taking part in the Event, the Event Participant provides the Contractor/Customer with the consent for his personal details collection and processing, subject to the Law of Ukraine “On personal details protection”. The Contractor/Customer shall independently bear responsibility for entering the personal details to the base of the personal details and processing of them pursuant to the Law of Ukraine “On personal details protection”.

o By taking part in the Event each Participant confirms his consent for the use of the provided information by the Event Customer/Contractor for marketing and/or any other purpose using the methods not violating the applicable laws of Ukraine (including by way of transfer to the third persons), in particular for free use of his name, surname, photo, interview, or other materials about him for the advertising/marketing purpose, including the right to publish (including his name and image, provided in the photo) in mass media, from any printed, audio and video materials, interview in mass media, and for the purpose of sending the information, notifications (including promotional) etc., without any limitations as for the territory, time and way of use, and such use will by no means compensated by the Event Customer/Contractor and/or by any third person. The provision of such consent will also be considered within the meaning provided for in the articles 296, 307 of the Civil Code of Ukraine.

o The Event Participants guarantee that they are entitled to participate in the Event (in particular, by performing the procedure determined herein), confirm and guarantee that they have all exclusive property and personal non-property copyrights and allied rights on the provided photos, and the incapable or partially capable persons confirm and guarantee that they have the properly executed written consent from their parents/guardians/custodians for use of their image for the promotional purposes in the Event not limited by the ways, time, or territory. The Event Participants shall bear the responsibility as provided for in the applicable laws of Ukraine for the violation of the intellectual property rights of the third persons.

o The Customer and the Contractor of the Event may involve the third persons for complete and/or partial fulfillment of the obligations hereunder.
