Prospekt shopping mall (hereinafter also referred to as the Shopping Mall) is located at the address: 1V Hnata Khotkevycha St., Kyiv.
The Shopping Mall is privately owned, and therefore the owner of the shopping mall ("Comfort Market Lux" Limited Liability Company) and the administration of the Shopping Mall independently, in compliance with the Constitution of Ukraine and the laws of Ukraine, determines the terms and conditions of visitors' stay on the territory of the Shopping Mall.
Opening hours of the Shopping Mall are from 10:00 to 22:00, daily.
Opening hours of the Auchan Hypermarket are from 08:00 to 23:00, daily.
Multiplex cinema opening hours are from 09:30 to 22:00, daily.
DEFINITION OF TERMS
Territory of the Shopping Mall - the building of the shopping mall, located at the address: 1V Hnata Khotkevycha St., Kyiv, parking of the Shopping Mall, green area of the Shopping Mall, including places where Visitors' access in accordance with the rules established by the Administration:
a) is always prohibited (technological premises, equipment locations, work locations, unloading areas, etc.);
b) is limited, i.e. possible only under certain conditions (office, administrative, warehouse premises, evacuation, fire, emergency exits, etc.);
c) is allowed, i.e. possible in compliance with the operating mode of the shopping mall, unless specifically restricted by the Administration (atriums, lobbies, restrooms, general areas of the Shopping Mall, etc.);
Administration - authorized representatives and/or employees of the owner of Prospekt shopping mall acting on his behalf and in his interests;
Visitor– any individual located on the territory of the Shopping Mall;
Shopping Mall Security Service - a person or group of persons who perform the functions of ensuring order, security, organizing Visitors' access to the Shopping Mall and monitoring compliance with these rules of the Shopping Mall.
1. GENERAL PROVISIONS
1.1. 1. By visiting the Shopping Mall, Visitors agree to these Rules in full, accept them and undertake to strictly comply with them. In case of disagreement in whole, or in any part with the Rules, with the requirements of the Administration, the Security Service of the Shopping Mall, the Visitor must refuse to visit the Shopping Mall (leave the territory of the Shopping Mall).
1.2. Since the Administration does not carry out activities related to the sale of goods, works, or services to Visitors, it is not subject to the provisions on consumer protection.
1.3. Providing access to Visitors to the Shopping Mall is carried out by the owner of the Shopping Mall in order to exercise their ownership powers and for the purpose of purchasing goods (works, services) by Visitors from tenants of the Shopping Mall who carry out their activities in the Shopping Mall under an agreement with the owner of the Shopping Mall.
1.4. The Administration takes measures to ensure a safe and comfortable stay of Visitors in the Shopping Mall, to prevent damage to Visitors or their property on the territory of the Shopping Mall, where Visitors are allowed access. At the same time, the owner of the Shopping Mall, the Administration and Security service of the Shopping Mall shall not be responsible for any damage that may be caused on the territory of the Shopping Mall to the property, life and health of Visitors, including caused by the actions (omissions) of tenants of the premises and (or) third parties, including the actions (omissions) of any visitors, and shall not be responsible for the safety of any property (things, documents, money, etc.) of any persons located on the territory of the Shopping Mall.
1.5. Visit to the Shopping Mall as a whole, or in its individual parts, may be restricted by the Administration, or the Security Service of the Shopping Mall, by determining places where access to Visitors is prohibited or restricted due to the establishment of the working hours of the Shopping Mall, or its individual parts; the introduction of a pass regime when accessing certain parts of the Shopping Mall and/or at certain times; denial of access to the Shopping Mall to Visitors who do not meet the requirements of the Rules and/or violate them, etc.
1.6. A Visitor who is denied access to a Shopping Mall must immediately leave the territory of the Shopping Mall (part of the Shopping Mall) and not attempt to enter it.
1.7. Actions of the Shopping Mall Security Service that, in the Visitor's opinion, do not comply with the Rules may be appealed to the Administration.
2. SHOPPING MALL VISITOR IS NOT ALLOWED TO:
2.1. Smoke tobacco and non-tobacco products, e-cigarettes, hookahs, and IQOS etc.
2.2. Violate public order, show obvious disrespect for citizens, accompanied by rude obscene language, offensive molestation of citizens etc.
2.3. Initiate quarrels, fights, and other conflicts, take part in them, show aggression towards others, and commit hooligan actions.
2.4. Organize illegal or unauthorized meetings by the Administration, including using various kinds of slogans, posters, banners, and take part in them.
2.5. Create and use photo and video creations that show the Shopping Mall or part of it (both inside and outside), except when such actions are agreed with the Administration. The exception is photos and videos created for personal purposes, which are carried out using mobile phones, if the person, taking photos and videos, by their actions does not create inconvenience to other Visitors to the Shopping Mall, does not violate public order, and provided that the photo (video) does not show other Visitors, employees of the Shopping Mall and the security system of the Shopping Mall;
2.6. Enter restricted areas or areas with limited access without fulfilling the conditions of stay in the latter.
2.7. Be in a Shopping Mall with an appearance that expresses obvious disrespect for citizens, insults human dignity and public morals.
2.8. Be on the territory of the Shopping Mall with animals (except for service dogs and guide dogs).
2.9. Leave children unattended.
2.10. Leave bags and personal items unattended.
2.11. Run, jump, climb fences, railings, technical structures, enter green areas and office premises decorated with appropriate information boards, jump from any height.
2.12. Sit on stairs, floors, fences, and sidewalks.
2.13. Enter sanitary areas during scheduled cleaning there.
2.14. Walk on wet floors and coverings.
2.15. Touch and move inventory, decorations, Shopping Mall decor elements, as well as any electrical equipment.
2.16. Damage the property of the Shopping Mall or third parties, commit any kind of illegal encroachments on it.
2.17. Go beyond the fences of places where repairs or any other types of work are carried out.
2.18. Be on the territory of the Shopping Mall in a state of alcoholic, narcotic, toxic intoxication, or under the influence of psychotropic substances.
2.19. Drink beer and beverages made on its basis, alcoholic and alcohol-containing products on the territory of the Shopping Mall, with the exception of the food court area where the respective tenants sell licensed alcoholic products.
2.20. Consume narcotic drugs or psychotropic substances on the territory of the Shopping Mall without a doctor's prescription, other intoxicating substances, as well as smoking in places not intended for these purposes.
2.21. Bring to the territory of the Shopping Mall:
- explosives, explosive devices;
- alcoholic beverages;
- any weapons and/or ammunition for them;
- self-defense equipment, stun devices, mechanical and automatic aerosol sprayers of all types;
- toxic substances;
- piercing and cutting objects;
- pyrotechnic devices.
2.22. Create a stampede on the territory of the Shopping Mall.
2.23. Without the consent of the Administration, conduct any kind of marketing, advertising, propaganda events (including musical and theatrical performances), distribute advertising and other information, carry out trade or other commercial activities.
2.24. Engage in vagrancy and/or begging.
2.25. Move around the Shopping Mall using bicycles, roller skates, skates, skateboards, scooters, gyroscuters, gyroboards, Segways, electric scooters, electric bikes and other vehicles and sports vehicles, except for wheelchairs.
2.26. Ride bicycles through the galleries of the Shopping Mall and store bicycles in the premises of the Shopping Mall. The Visitors can only park their bicycles in a specially designated place - a bike park, in front of the entrance groups of the Shopping Mall.
2.27. Use the passenger elevator to transport food carts and oversized cargo.
2.28. Use escalators to transport baby strollers, oversized cargo, and grocery carts.
2.28. Perform other actions that violate public order, express obvious disrespect for citizens, cause harm to the life, health or property of third parties, or pose a threat of causing such harm.
2.29. Be in untidy or dirty clothes and shoes, dirty interior items or food court Visitors;
2.30. Provoke conflicts and get into fights, whistle and shout loudly, speak in raised tones, use obscene language;
2.31. Use sound reinforcement tools (other than hearing aids) and listen to audio recordings or audio broadcasts without headphones;
2.32. Be in the area of the Shopping Mall food court without the documents provided for in Clause 8 of the Rules.
3. THE VISITOR TO THE SHOPPING MALL MUST:
3.1. Inform the Shopping Mall Security Service about the presence of items with which access to the Shopping Mall is prohibited according to the rules.
3.2. At the request of the Shopping Mall Security Service, present large bags and boxes for inspection. Meeting this requirement is one of the conditions for allowing the Visitor to enter the Shopping Mall or a specific area of the Shopping Mall.
3.3. Comply with the requirements of the applicable laws, the Constitution of Ukraine and these rules of the Shopping Mall.
3.4. Leave the territory of the Shopping Mall if such a request is made by representatives of the Shopping Mall Administration or employees of the Shopping Mall Security Service.
4. THE VISITOR TO THE SHOPPING MALL HAS THE RIGHT TO:
4.1. Get complete information about the working hours of the Shopping Mall, the Administration, individual tenants of the Shopping Mall, and the current rules of the Shopping Mall.
4.2. Visit areas of the Shopping Mall with the permitted access mode and taking into account the operating mode of the Shopping Mall and its individual parts, in compliance with the requirements of these Rules.
5. RULES FOR USING SHOPPING MALL'S ESCALATORS:
5.1. While on the escalator the Visitor must:
1. Stand to the right, facing the direction of travel, holding on to the handrail.
2. Pass from the left side, holding on to the handrail.
5.2. While on the escalator the Visitor is not allowed to:
1. Touch the fixed parts of the escalator, stick your fingers, hands, clothing, and any other objects into the escalator stairs, under the escalator handrail, in the gap between the escalator stairs and the balustrade, and/or in the comb when leaving the escalator.
2. It is forbidden to transport bulky luggage, bottles, baby strollers, grocery carts, bicycles, or any other items on the escalator stairs and/or handrails.
3. Lie down, sit down, or lean on the escalator handrail.
4. Leave children unattended on the escalator. When using the escalator, it is recommended to hold children under 7 years of age in your arms, and children under 14 years of age should be held by the hand.
5. Run along the escalator. Move against the moving direction of the escalator.
6. Step over the yellow line of the escalator.
6. RIGHTS AND OBLIGATIONS OF VISITORS TO THE FOOD COURT ZONE:
6.1. Visitors to the food court must:
1. Observe public order and the laws of Ukraine;
2. Pay for ordered meals and drinks;
3. Don't interfere with other Visitors;
4. Carefully and responsibly treat the property of the Shopping Mall (furniture, dishes, plumbing, etc.), and in case of damage to this property, compensate for the damage caused.
5. Have with them the valid documents provided for in Clause 8 of the Rules.
6.2. Food court visitors have the right to:
1. Pay for the order in cash or by bank card;
2. Visit the cafe with children, observing the rules of the location.
6.3. Visitors are not allowed to:
1. Consume alcoholic beverages brought with them;
2. Move free tables and chairs without the Administration's permission;
3. Play cards or other gambling games, as well as team story games;
4. Use the food court areas for eating and drinking brought with you;
5. On days/hours with high occupancy of the food court, it is forbidden to occupy tables for purposes not related to eating;
6. Sit on the floor, put your feet on the furniture;
7. Sit or dance on tables, railings;
8. Sit at tables, consume food or drinks without having the documents provided for in Clause 8 of the Rules.
7. WORK OF MEDIA ON THE TERRITORY OF THE SHOPPING MALL
7.1. Journalists and/or employees of mass media, including TV channels (hereinafter referred to as – "Mass media") allowed to take photos and videos on the territory of the Shopping Mall only after accreditation. For photo and video shooting on the territory of stores, they must also obtain consent from the store's authorized representatives.
Photo and video recording of individuals (including employees of the Administration, Shopping Mall Security Service, etc.) shall be carried out on condition that the Mass media receives written consent from such individuals.
7.2. Mass media representatives shall be accredited and interacted with by the Director of Communications.
The Mass media accreditation procedure provides that an application shall be submitted on the editorial board letterhead signed by the Mass media executive (or an authorized person) stating:
- full name of the Mass media;
- date and number of state registration of the Mass media;
- address of the Mass media editorial office;
- email address (if any) of the Mass media;
- surname, first name, patronymic (if any) of the Mass media representative in respect of whom the submission is made;
- numbers of communication with the Mass media;
- topic, plot program, questions that will be revealed (asked);
- desired shooting day and time.
An accreditation application that does not contain the above information shall not be considered.
The application shall be processed by the Director of Communications who will recommend the Speaker and related information for citations, synchrons, and visuals.
7.3. The Director of Communications has the right to refuse Mass media accreditation if:
- Mass media is included in the sanctions list;
- the topic and/or program of the story may have a negative impact on the reputation of the Shopping Mall, Administration, owner, or related parties;
- on other grounds.
7.4. Depending on the topic and/or plot program, the Media accreditation rules may have separate additional conditions, which will be announced in advance by the Director of Communications.
7.5. Mass media accreditation shall be valid only for one agreed event.
8. QUARANTINE-RELATED RESTRICTIONS
During the quarantine period, Visitors to the Shopping Mall must:
1. undergo temperature screening or visual examination for signs of respiratory diseases;
2. maintain a social distance (1.5 meters);
3. stay on the territory of the Shopping Mall only wearing a protective mask covering nose and mouth;
4. at the first request of the Administration or Shopping Mall Security Service provide for inspection and verification of the documents required for the implementation of measures (activities) without applying restrictions established to the appropriate level of epidemic danger (negative test result for COVID-19 by polymerase chain reaction or rapid test for the determination of the SARS-CoV-2 coronavirus antigen, or a document confirming the vaccination);
5. consume food and beverages on the territory of the Shopping Mall (including in the food court area) only if there is a negative test result for COVID-19 by polymerase chain reaction or a rapid test to determine the SARS-CoV-2 coronavirus antigen, or a document confirming the vaccination.
